Clever Logger Terms of Service

Clever Logger is supplied by Clever Logger Pty Ltd. These Terms of Service explain the general terms that apply to the use of the Clever Logger system, including Clever Logger hardware, the Clever Logger cloud platform, alerts, reporting, data access and related support services.

These terms are intended to be read alongside our general Terms and Conditions of Sale, which include our standard warranty and liability provisions. Existing warranty terms are already set out in the Clever Logger Terms and Conditions, including the twelve-month warranty for most products and the stated limits on repair, replacement and liability.

1. The Clever Logger service

Clever Logger is a wireless temperature and environmental monitoring system. It is designed to help organisations monitor equipment such as fridges, freezers, rooms and other monitored locations.

The Clever Logger service may include Clever Logger loggers, gateways and accessories; access to the Clever Logger cloud platform; temperature and environmental data storage; alert notifications; downloadable reports; user access controls; and support provided by Clever Logger Pty Ltd.

Clever Logger is intended to reduce the risk of missed temperature events, but it does not remove the customer’s responsibility to manage, maintain and respond to the equipment being monitored.

2. Customer responsibilities

The customer is responsible for installing and using Clever Logger in a suitable manner, responding to alarms and notifications, maintaining monitored equipment, replacing batteries when required, keeping contact details current, and ensuring that the people nominated to receive alerts are appropriate and available.

The customer is also responsible for checking that Clever Logger is suitable for its intended use, including any internal compliance, clinical, food safety, aged care, vaccine storage, pharmaceutical or audit requirements.

Clever Logger helps provide monitoring records and alerts, but it does not make operational decisions on behalf of the customer.

3. Licensing and access

Access to the Clever Logger cloud platform is provided for the customer’s authorised users.

The customer may create, manage and remove user access as required for its organisation. Users must keep login details secure and must not share access in a way that compromises the system.

Clever Logger Pty Ltd may suspend or restrict access where reasonably necessary to protect the security, stability or integrity of the Clever Logger platform, or where the system is being misused.

4. Service commitments

Clever Logger Pty Ltd aims to provide a reliable cloud monitoring service and practical support for Clever Logger customers.

The Clever Logger system depends on several external factors, including internet access, local network connectivity, email delivery, notification services, power supply, and the condition of the customer’s own equipment. Because of this, Clever Logger Pty Ltd cannot guarantee that every alert will be delivered instantly or that the system will be uninterrupted at all times.

Where planned maintenance is required, Clever Logger Pty Ltd will use reasonable efforts to minimise disruption.

5. Alerts and notifications

Clever Logger can send alerts when monitored conditions fall outside configured limits, when a logger stops communicating, or when other nominated events occur.

The customer is responsible for selecting appropriate alarm limits, alert delays, escalation settings and recipients. The customer is also responsible for ensuring that nominated recipients monitor their email, phone or other alert channels.

Alerts are intended as a risk-reduction tool. They should not be the customer’s only process for managing critical stock, medication, vaccines, food, samples or other temperature-sensitive items.

6. Data ownership

The customer owns the data generated by its Clever Logger devices and account.

This includes temperature records, logger history, alarm history, reporting data and related customer account data.

Identifying data can be deleted upon formal request from the customer. The data deleted will include organisation details, user details and location details. This excludes financial records and other information that needs to be legally retained.

Ownership does not include a right to delete historical device readings. The customer owns the data generated by its use of the Clever Logger service, but agrees that historical readings must remain intact to preserve the reliability of the monitoring system. These readings, however, will no longer be linked to an account and are totally de-identified.

The customer may export or access its data, but may not delete, modify or obscure historical records except as permitted by the service or required by law.

Clever Logger Pty Ltd may store, process and back up this data for the purpose of providing the Clever Logger service, support, troubleshooting, security, system maintenance and service improvement.

Clever Logger Pty Ltd will not claim ownership of the customer’s monitoring data.

7. Data access and export

Customers can access their Clever Logger data through the Clever Logger cloud platform, including reports and historical records available within the system.

If a customer terminates the service and requests an export of its data, Clever Logger Pty Ltd can provide an export of all available customer data within two weeks of the request.

The export will be provided in a reasonable format determined by Clever Logger Pty Ltd, such as CSV, spreadsheet or another commonly usable format.

Exporting data does not require Clever Logger Pty Ltd to delete or alter historical records retained in the Clever Logger system, except where required by law.

8. Privacy and confidentiality

Clever Logger Pty Ltd will take reasonable steps to protect customer account information and Clever Logger data.

Customer data will only be accessed by Clever Logger Pty Ltd where reasonably required to provide support, investigate technical issues, maintain the service, meet legal obligations, or improve the reliability and security of the Clever Logger platform.

Customers are responsible for ensuring that any personal information they enter into Clever Logger is appropriate and lawful for their own use case.

9. Warranties

Hardware warranty terms are covered by the Clever Logger Terms and Conditions of Sale.

In summary, a twelve-month warranty applies to the majority of products. Faulty goods may be returned to Clever Logger Pty Ltd for repair within the warranty period, provided the fault is covered by the warranty. The existing terms exclude issues such as misuse, abnormal use, improper maintenance, unauthorised alterations or repairs, dead batteries and other excluded events.

The Clever Logger service is provided as a monitoring and alerting tool. While Clever Logger Pty Ltd works to provide a reliable system, the service is not guaranteed to be error-free, uninterrupted or suitable for every possible application.

10. Liability

Clever Logger is designed to reduce risk by improving monitoring, record keeping and alerts. It cannot eliminate all risk.

The customer remains responsible for the goods, equipment, rooms, fridges, freezers or other assets being monitored, including decisions made in response to alarms or reports.

To the extent permitted by law, Clever Logger Pty Ltd’s liability is limited in accordance with its standard Terms and Conditions. The existing terms state that compensation by Clever Logger Pty Ltd may be limited, at Clever Logger Pty Ltd’s option, to repairing faulty goods or refunding their purchase price.

Clever Logger Pty Ltd is not liable for losses caused by misuse, incorrect configuration, failure to respond to alerts, failure of the customer’s internet or network, failure of third-party services, failure of monitored equipment, or use of Clever Logger outside its intended purpose.

11. Termination

The customer may terminate use of the Clever Logger service at any time.

If the customer wishes to terminate and receive an export of its data, the customer should request this in writing. Clever Logger Pty Ltd can provide an export of all available customer data within two weeks of the termination request.

After termination, Clever Logger Pty Ltd may disable access to the customer’s Clever Logger account and stop receiving data from the customer’s devices.

Clever Logger Pty Ltd may also terminate or suspend access where the customer has materially misused the service, failed to pay amounts owing, compromised system security, or used the service in a way that creates risk for Clever Logger Pty Ltd, other customers or the Clever Logger platform.

12. Changes to the service

Clever Logger Pty Ltd may update, improve or modify the Clever Logger service over time. This may include changes to software features, reporting, alerts, user interface, hardware compatibility or support processes.

Where a change materially affects existing customers, Clever Logger Pty Ltd will use reasonable efforts to communicate the change.

13. Relationship with other terms

These Terms of Service should be read together with Clever Logger Pty Ltd’s general Clever Logger Terms and Conditions of Sale, Privacy Policy and any written quotation, purchase order or agreement that applies to the customer.

If a specific written agreement has been signed between Clever Logger Pty Ltd and the customer, that agreement will take priority to the extent of any inconsistency.
